Nondiscrimination/Harassment (Students) (BP/AR 5145.3)

  1. Any student, or the student’s parent/guardian who believes that he/she has been the victim of unlawful harassment, intimidation, bullying, and/or discrimination should immediately contact a school site administrator or other District administrator.

  2. Any student, or the student’s parent/guardian may file a complaint alleging that they have been the victim of unlawful harassment, intimidation, bullying, and/or discrimination in accordance with the Uniform Complaint Procedure (Board Policy/Administrative Regulation 1312.3)

  3. The district designates the individual(s) identified below as the employee(s) responsible for coordinating the district's efforts to comply with applicable state and federal civil rights laws, including Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act, and the Age Discrimination Act of 1975, and to answer inquiries regarding the district's nondiscrimination policies. The individual(s) shall also serve as the compliance officer(s) specified in AR 1312.3 - Uniform Complaint Procedures:

    1. Deputy Superintendent, Educational Services is the Title IX Compliance Officer for student-to-student harassment, intimidation, bullying, and/or discrimination and is designated by the District to receive and process complaints under this procedure.     2. The Associate Superintendent, Human Resources is the Title IX Compliance Officer for any student harassment and/or discrimination complaints involving employees of the District either engaging in, or being the victim of harassment, intimidation, bullying, and/or discrimination.     3. The Associate Superintendent, Student Support Services is the Compliance Officer for any student complaints related to Section 504 of the Rehabilitation Act of 1973, or Title II of the Americans with Disabilities Act. The Associate Superintendent can be reached at:

    4. A written statement, and/or any submitted Uniform Complaint forms, will be forwarded by the principal/designee to the Associate Superintendent, Educational Services; the Associate Superintendent, Human Resources; or the Associate Superintendent, Student Support Services. If the complaint involves the principal/designee, the complaint shall be filed directly with the Associate Superintendent, Human Resources.

    5. These procedures do not deny the right of any individual to pursue other avenues of recourse which may include filing charges with other agencies, initiating civil action or seeking redress under State criminal statues and/or Federal law.
